Canadian CMVSS certification

Transport Canada (TC) is mainly responsible for road transport and rail transport in Canada. The Minister of Transport is responsible for managing and implementing the Motor Vehicle Safety Act, and appoints inspectors to be responsible for certification, supervision and inspection. Canada's Motor Vehicle Safety Act requires that vehicles and parts within the specified categories must be approved by Transport Canada for export to Canada. The Canadian Motor Vehicle Safety Standard (CMVSS), based on the Motor Vehicle Safety Act and safety regulations, specifies the types of vehicles that need to be controlled.

The Motor Vehicle Safety Agency under the Ministry of Transport of Canada is the specific implementing agency of the Motor Vehicle Safety Act. The Motor Vehicle Safety Administration conducts post market supervision by means of situation inspection, testing, company audit, investigation of safety related defect allegations and recovery monitoring.

The Attorney General of Canada is responsible for all proceedings relating to the Motor Vehicle Safety Act. The Canadian Prosecutors' Court (PPSC) has fulfilled the responsibility of the Attorney General of Canada in the implementation of his criminal law mandate by prosecuting criminal offences under federal jurisdiction. Canadian transport law enforcement officers provide PPSC with information and suggestions on prosecution, and PPSC decides whether to prosecute. The Federal Court makes a final decision on the outcome of a lawsuit for violation of the Motor Vehicle Safety Act, including fines imposed. The Federal Court will also review mandatory orders issued by the Minister.
